An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public sanitary sewer mains, sanitary sewer manholes and easements, and to accept new public water and sanitary sewer mains, fire hydrant assemblies, sanitary sewer manholes and associated easements, for nine properties located at Dickerson Pike, Gatewood Avenue and Marie Street, also known as The Pike Phase 1 (MWS Project Nos. 25-WL-31 and 25-SL-69 and Proposal No. 2025M-191ES-001).

WHEREAS, the abandonment of approximately 1,022 linear feet of eight-inch sanitary sewer main, approximately 232 linear feet of 10-inch sanitary sewer main, six sanitary sewer manholes and easements, and the acceptance of approximately 1,258 linear feet of new eight-inch water main (DIP), approximately 746 linear feet of new eight-inch sanitary sewer main (PVC), approximately 335 linear feet of new eight-inch sanitary sewer main (DIP), approximately 419 linear feet of new 10-inch sanitary sewer main (PVC), approximately 161 linear feet of new 10-inch sanitary sewer main (DIP), two fire hydrant assemblies, 18 sanitary sewer manholes and associated easements, for nine properties located at Dickerson Pike, Gatewood Avenue, and Marie Street, also known as The Pike Phase 1, are needed to construct Project Nos. 25-WL-31 & 25-SL-69; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2025M-191ES-001 on January 8, 2026, for the abandonment and acceptance of said water and sanitary sewer mains, fire hydrant assemblies, sanitary sewer manholes and associated easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 1,022 linear feet of eight-inch sanitary sewer main, approximately 232 linear feet of 10-inch sanitary sewer main, six sanitary sewer manholes and easements, and to accept approximately 1,258 linear feet of new eight-inch water main (DIP), approximately 746 linear feet of new eight-inch sanitary sewer main (PVC), approximately 335 linear feet of new eight-inch sanitary sewer main (DIP), approximately 419 linear feet of new 10-inch sanitary sewer main (PVC), approximately 161 linear feet of new 10-inch sanitary sewer main (DIP), two fire hydrant assemblies, 18 sanitary sewer manholes and associated easements, for nine properties located at Dickerson Pike, Gatewood Avenue and Marie Street, also known as The Pike Phase 1, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
