A resolution approving an Intergovernmental Participation Agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and the State of Tennessee, Department of General Services to provide improved public sanitary sewer service through the construction of an improved stormwater system. WHEREAS, the State of Tennessee (“STATE”) is constructing the Tennessee State Library and Archives (“TSLA”) building and designing the TSLA to discharge stormwater into the combined sewer system in a manner that is in accordance with current standards; and,
WHEREAS, the Metropolitan Department of Water and Sewerage Services (“METRO”) instead desires to have the TSLA stormwater discharged into a dedicated storm system that currently exists, but that requires upgrades due to capacity limitations and increased additional flow from the TLSA site, as shown in Exhibit 1 hereto attached; and,
WHEREAS, STATE agrees to provide METRO the amount of $515,415.00 to fund the upgrades, including design and construction of the current and new stormwater systems, in accordance with the terms of the Intergovernmental Participation Agreement, attached as Exhibit 1; and,
WHEREAS, STATE and METRO agree that any unused portion of the payment for design and construction costs shall be refunded to the STATE; and,
WHEREAS, METRO agrees to begin design and construction of the project within timeframes set forth by Metro Water Services upon receiving the funds; and,
WHEREAS, the provision of such storm sewer service improvement is deemed to benefit both parties and the general community.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
Section 1. That the Intergovernmental Participation Agreement (Exhibit 1) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and the State of Tennessee, Department of General Services, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. The funds in the amount of $515,415.00 collected pursuant to the Intergovernmental Participation Agreement shall be deposited into the 47335 fund, and monies shall be allocated exclusively for improvements to the Current Stormwater System and construction of a New Stormwater System.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an intergovernmental participation agreement between the Department of Water and Sewerage Services (MWS) and the Tennessee Department of General Services for stormwater and sewer infrastructure related to the construction of the Tennessee State Library and Archives building. The State has agreed to pay Metro $515,415 to fund the design and construction of current and new stormwater systems by Metro. This work will separate stormwater and sewer flow from this site in order to reduce the potential for storm flooding, surcharging sewer, and odor in the area, as well as improve water quality in the Cumberland River. Any unused portion of these funds will be refunded to the State.
Future amendments to this legislation may be approved by resolution. This agreement has been approved by the Planning Commission.
