Analysis
On April 7, 2025, Leta Pitt was driving in the right lane of East Trinity Lane and approached Casper Avenue. A Metropolitan Nashville Police Department (“MNPD”) officer was stopped in the turn lane when he received a call for service. The officer turned on his emergency lights and attempted to merge into the right lane of East Trinity Lane to turn right onto Casper Avenue. The patrol car struck Ms. Pitt’s car, forcing her vehicle onto the sidewalk. The car was declared a total loss, and $2,900 was paid to Ms. Pitt through a separate claim.
Ms. Pitt later went to the emergency room with complaints of pain in her neck, left shoulder, and back. She received treatment for the pain, including physical therapy, over the course of seven months. Ms. Pitt filed a claim against the Metropolitan Government for medical damages.
The parties have participated in settlement negotiations and have agreed upon the settlement amount of $55,000. The Department of Law recommends settlement of Ms. Pitt’s personal injury claim for $55,000.
Fiscal Note: The total settlement amount is $55,000. This settlement, along with Resolution Nos. RS2026-2117, RS2026-2118, RS2026-2129 and RS2026-2133, would be the 1st, 2nd, 3rd, 4th and 5th payment, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY27 for a cumulative total of $507,258. The fund balance would be $12,324,333 after this payment.
