WHEREAS, on October 8, 2025, August Brooks was involved in an accident with a Metro Water Services vehicle while approaching the intersection of Whites Creek Pike and Green Lane. As Ms. Brooks was approaching the intersection, a Metro Water Services driver attempted to make a left turn onto Whites Creek Pike from Green Lane, causing a collision with Ms. Brooks’ vehicle and injury to her; and,
WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that any and all claims or causes of action brought or that could have been brought by August A. Brooks related to the events detailed above, be compromised and settled for $28,000, and that this amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the personal injury claim of August A. Brooks for the sum of $28,000, with said amount to be paid from the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

On October 8, 2025, August Brooks was driving along Whites Creek Pike. A Metro Water Services (“MWS”) vehicle was stopped at the intersection of Green Lane and Whites Creek Pike. The MWS driver attempted to turn left on Whites Creek Pike. The MWS driver could not stop his vehicle in time and struck the right side of Ms. Brooks’ car. The repair estimate for the car was $1,159.34 and has been paid through a separate claim.
Ms. Brooks went to the emergency room the following day with complaints of pain in her right arm, shoulder, and hip. After receiving a CT scan, she was diagnosed with a ligament sprain of the cervical spine and lumbar spine. Ms. Brooks received treatment for the pain until December 22, 2025. Ms. Brooks brought a claim seeking medical damages.
The parties have participated in settlement negotiation and have agreed upon the settlement amount of $28,000. The Department of Law recommends settlement of Ms. Brooks’ claim for $28,000.
The MWS employee involved was not disciplined, based on supervisor discretion.
Fiscal Note: The total settlement amount is $28,000. This settlement, along with Resolution Nos. RS2026-2117, RS2026-2118, RS2026-2129 and RS2026-2130, would be the 1st, 2nd, 3rd, 4th and 5th payment, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY27 for a cumulative total of $507,258. The fund balance would be $12,324,333 after this payment.
