WHEREAS, on April 3, 2025, raw sewage and debris entered the downstairs bathroom of Charley Rodriguez’s home at 3218 Cloverwood Drive causing extensive damage to the property; and,   

WHEREAS, after investigation, the Department of Law believes the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the property damage claim of Charley Rodriguez be compromised and settled for a total of $32,710.71, and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1:                       The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of Charley Rodriquez for the sum of $32,710.71, with said amount to be paid from the Self-Insured Liability Fund.

Section 2:                       This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

On April 3, 2025, raw sewage and debris entered the lower level of a home owned by Charley Rodriguez at 3218 Cloverwood Drive. The manhole in the property’s backyard overflowed for more than 24 hours. Mr. Rodriguez initially contacted his Council Member instead of Metro Water Services when the incident occurred. Damage to the living area in Mr. Rodriguez’s basement totaled $32,710.71.

 

When Metro Water Services arrived the following day, the manhole was no longer overflowed. However, a vehicle was parked over the manhole and prevented MWS from televising the line. MWS returned on June 2, 2025, found that no water was flowing from the manhole, and cleaned the sewer main for grit. MWS returned again on June 14, 2025, televised the line, and found a dry clean-out.

 

The parties have participated in settlement negotiations and have agreed upon the settlement amount of $32,710.71, subject to approval from the Metropolitan Council. The Department of Law recommends settlement of Mr. Rodriguez’s property damage claim for $32,710.71.

 

Fiscal Note: The total settlement amount is $32,710.71. This settlement, along with Resolution No. RS2025-1641, would be the 14th and 15th payments, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY26 for a cumulative total of $2,053,210. The fund balance would be $11,521,663 after these payments.
