A resolution to amend Ordinance No. BL2022-1236 to authorize The Metropolitan Government of Nashville and Davidson County to modify the abandonment of existing public water mains, and the acceptance of new public water mains and fire hydrant assemblies, for property located at 39th Avenue North (unnumbered) (MWS Project No. 22-WL-08 and Proposal No. 2022M-051ES-002).

WHEREAS, Ordinance No. BL2022-1236, approved, June 9, 2022, authorized the abandonment of approximately 1,250 linear feet of existing two inch water main and approximately 40 linear feet of existing six inch water main, and the acceptance of approximately 838 linear feet of new eight inch water main (DIP), approximately seven linear feet of new six inch water main (DIP) and two fire hydrant assemblies, for property located at 39th Avenue North (unnumbered); and,
WHEREAS, the previously approved abandonment of approximately 232 linear feet of two-inch water main, and the previously approved acceptance of approximately seven linear feet of new six-inch water main (DIP), approximately 389 linear feet of new eight-inch water main (DIP), and one fire hydrant assembly, are no longer needed to construct Project No. 22-WL-08; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-051ES-002 on April 3, 2026, for revisions to the original mandatory referral; and,
WHEREAS, Ordinance No. BL2022-1236 provides that amendments to the legislation shall be approved by resolution.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. That Ordinance No. BL2022-1236 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 1,018 linear feet of existing two-inch water main and approximately 40 linear feet of existing six inch water main, and to accept approximately 449 linear feet of new eight inch water main (DIP) and one fire hydrant assembly, for property located at 39th Avenue North (unnumbered), as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

The proposed resolution would amend Ordinance No. BL2022-1236 to abandon 232 fewer linear feet of two-inch water main and accept approximately seven linear fewer feet of new six-inch water main, approximately 389 fewer linear feet of new eight-inch water main (DIP), and one less new fire hydrant assembly at 39th Avenue North (unnumbered).
This amendment has been approved by the Planning Commission.
