A resolution to amend Ordinance No. BL2019-1565, as amended, to authorize The Metropolitan Government of Nashville and Davidson County to modify previously accepted sanitary sewer main and to accept additional sanitary sewer main, sanitary sewer manholes and easements and update Map and Parcel information, for now two properties located at 600 and 640 21st Avenue North (MWS Project Nos. 19-WL-95 and 18-SL-203 and Proposal No. 2019M-025ES-003).

WHEREAS, Ordinance No. BL2019-1565, approved May 8, 2019, and amended by Resolution No. RS2020-280, approved April 22, 2020, authorized the abandonment of approximately 85 linear feet of existing eight inch water main, approximately 326 linear feet of existing 18 inch sanitary sewer main, four sanitary sewer manholes and easements, and the acceptance of approximately 611 linear feet of new eight inch sanitary sewer main (PVC), approximately 126 linear feet of new 18 inch sanitary sewer main (RCP), 10 sanitary sewer manholes and easements, for four properties located at 608 and 615 Spruce Street, and 610 and 21st Ave North (unnumbered); and,
WHEREAS, the acceptance of approximately 114 linear feet of new eight inch sanitary sewer main (DIP), approximately 135 linear feet of new 24 inch sanitary sewer main (RCP), approximately 188 linear feet of new 12 inch sanitary sewer main (DIP), approximately 230 linear feet of new 12 inch sanitary sewer main (PVC), two additional sanitary sewer manholes and easements, are needed to construct project numbers 19-WL-95 and 18-SL-203; and,
WHEREAS, the previously approved acceptance of approximately 415 linear feet of new eight inch sanitary sewer main (PVC), and approximately 126 linear feet of new 18 inch sanitary sewer main, are no longer needed to construct Project No. 18-SL-203; and,
WHEREAS, the four properties located at 608 and 615 Spruce Street, and 610 and 21st Avenue North (unnumbered), are now two properties located at 600 and 640 21st Avenue North; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M-025ES-003 on October 12, 2020, for the abandonment and acceptance of said water and sanitary sewer main, sanitary sewer manholes and easements and updated Map and Parcel information; and,
WHEREAS, Ordinance No. BL2019-1565 provides that amendments to the legislation shall be approved by resolution.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. That Ordinance No. BL2019-1565 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 85 linear feet of existing eight inch water main, approximately 326 linear feet of existing 18 inch sanitary sewer main, four sanitary sewer manholes and easements, and to accept approximately 196 linear feet of new eight inch sanitary sewer main (PVC), approximately 114 linear feet of new eight inch sanitary sewer main (DIP), approximately 135 linear feet of new 24 inch sanitary sewer main (RCP), approximately 188 linear feet of new 12 inch sanitary sewer main (DIP), approximately 230 linear feet of new 12 inch sanitary sewer main (PVC), 12 sanitary sewer manholes and easements, for two properties located at 600 and 640 21st Ave North, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

BL2019-1655 approved the abandonment of approximately 85 linear feet of existing eight inch water main, approximately 326 linear feet of existing 18 inch sanitary sewer main, four sanitary sewer manholes and easements, and the acceptance of approximately 611 linear feet of new eight inch sanitary sewer main, approximately 126 linear feet of new 18 inch sanitary sewer main, 10 sanitary sewer manholes and easements, for four properties located at 608 and 615 Spruce Street, and 610 and 21st Ave North (unnumbered).
This resolution accepts approximately 114 linear feet of new eight inch sanitary sewer main, approximately 135 linear feet of new 24 inch sanitary sewer main (RCP), approximately 188 linear feet of new 12 inch sanitary sewer main (DIP), approximately 230 linear feet of new 12 inch sanitary sewer main, two additional sanitary sewer manholes and easements. In addition, approximately415 linear feet of new eight inch sanitary sewer main, and approximately 126 linear feet of new 18 inch sanitary sewer main previously accepted are no longer needed. The four properties located at 608 and 615 Spruce Street and 610 and 21st Avenue North (unnumbered) have now become two properties located at 610 and 21st Avenue North.
This proposal has been approved by the Planning Commission.
Fiscal Note: This ordinance has no cost to Metro. Donated and abandoned easements have no market value according to the Department of Water Services.
