WHEREAS, RS2021-1237 approved Agreement No. 210258, an intergovernmental agreement between TDOT and the Metropolitan Government, through NDOT, for the acceptance of work in connection with the early acquisition of right-of-way to include six parcels for Phase 1-North/South Arterial Boulevard between Spring Street and Woodland Street (“the Agreement”); and,

 

WHEREAS, RS2022-1410 approved Amendment 1 to the Agreement to adjust downward the total project costs from $50,880,000 to $50,000,000, with NDOT continuing to be responsible for 50% of the project costs; and,

 

WHEREAS, pursuant to Amendment 2, attached hereto, the Parties desire to extend the project completion date to January 31, 2026; and,

 

WHEREAS, Tennessee Code Annotated Section 12-9-104(a)(2)(b) authorizes the Metropolitan Government to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

 

WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this amendment be approved.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

 

Section 1.                     That Amendment 2 to Agreement No. 210258 between the State of Tennessee, Department of Transportation and the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Department of Transportation and Multimodal Infrastructure, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

 

Section 2.                       Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

 

Section 3.                     That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.

This resolution approves the second amendment to an agreement between the Tennessee Department of Transportation (“TDOT”) and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) for the acceptance of work in connect with the early acquisition of right-of-way of six parcels for Phase 1-North/South Arterial Blvd between Spring Street and Woodland Street. The Council previously approved this agreement pursuant to Resolution No. RS2021-1237. The first amendment, approved by Resolution No. RS2022-1410, reduced the total project costs to $50,000,000. NDOT is responsible for 50% of the project costs.

 

The amendment under consideration extends the project completion date from January 15, 2024, to January 31, 2026, in order to complete the full acquisition of six parcels for the project. No additional funding is being requested.
