WHEREAS, on July 2, 2025, a water main broke in the front yard of 3721B Estes Road.  David Gonzales owns property at 3719 Estes Road.  The broken water main caused water to flow onto Mr. Gonzales property damaging the foundation and crawlspace of his home; and,     

WHEREAS, after investigation, the Department of Law believes the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the property damage claim of David Gonzales be compromised and settled for a total of $36,612.00, and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1:                       The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of David Gonzales for the sum of $36,612.00, with said amount to be paid from the Self-Insured Liability Fund.

Section 2:                       This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

On July 2, 2025, a water main broke in the front yard of 3721B Estes Road. The water from the broken main flowed into the home next door at 3719 Estes Road, owned by David Gonzales. The incident caused extensive damage to the foundation and crawlspace. A later analysis showed that the water main break occurred due to natural causes.

 

The parties have participated in settlement negotiations and have agreed upon the settlement amount of $36,612, subject to approval from the Metropolitan Council. The Department of Law recommends settlement of Mr. Gonzales’ property damage claim for $36,612.

 

Fiscal Note: The total settlement amount is $36,612. This settlement would be the 22nd payment, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY26 for a cumulative total of $2,799,731. The fund balance would be $11,352,980 after this payment.
