An ordinance to amend Chapter 10.64.018 of the Metropolitan Code, to establish an updated fee schedule for the Fire Marshal’s Office.

WHEREAS, Tennessee Code Annotated § 68-120-101 allows local governments to adopt either the International Fire Code, published by the International Code Council, Inc., or the NFPA 1 Fire Code, published by the National Fire Protection Association, Inc., provided the local government certifies to the state fire marshal that it is adequately enforcing such code; and,

WHEREAS, pursuant to BL2025-1004, the Metropolitan Government adopted the 2024 edition of the International Fire Code, as amended, published by the International Code Council, and the 2024 edition of NFPA 101 Life Safety Code, as amended, published by the National Fire Protection Association, Inc.; and,

WHEREAS, Sections 105.5 and 105.6 of the 2024 edition of the International Fire Code authorizes an agency to issue operational and construction permits; and,

WHEREAS, Section 108.2 of the 2024 edition of the International Fire Code authorizes an agency to establish a schedule of fees to offset the cost of providing inspections and other services by charging fees for the issuance of permits; and

WHEREAS, BL2018-1187 codified a fee schedule for permits issued by the Fire Marshal’s Office in Section 10.64.018 of the Metropolitan Code, and provided that future modifications to the Fire Marshal’s Office fee schedule shall be approved by a resolution adopted by the Metropolitan Council; and,

WHEREAS, such updates are adopted by the Metropolitan Council into the Metropolitan Code of Laws as the governing standards for Davidson County, Tennessee; and,

WHEREAS, the amendments of these sections of the Metropolitan Code are in the best interest of the citizens of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Section 10.64.018 of the Metropolitan Code is hereby amended by deleting Section A and substituting in lieu thereof:

A.                     The Fire Marshal’s Office shall charge the following for NFD permit fees:

1.                     Aerosol products: $119.00.

2.                     After hours inspection: $350.00.

3.                     After hours standby: $213.00.

4.                     Amusement areas: $151.00.

5.                     Aviation facilities: $151.00.

6.                     Carnivals and fairs: $151.00.

7.                     Cellulose nitrate film: $151.00.

8.                     Combustible dust-producing operations: $151.00.

9.                     Combustible fibers: $151.00.

10.                     Combustible storage: $151.00.

11.                     Compressed gases: $151.00.

12.                     Concession trailer/food truck (mobile food preparation vehicles): $151.00.

13.                     Cryogenic fluids: $151.00.

14.                     Day care operation: $151.00.

15.                     Dry cleaning: $151.00.

16.                     Energy storage systems: $151.00.

17.                     Exhibits and trade shows: $151.00.

18.                     Explosives: $166.00.

19.                     Flammable and combustible liquids: $151.00.

20.                     Fire/Life Safety Permit: $151.00.

21.                     Gates and barricades across fire department access roads: $151.00.

22.                     Hazardous materials: $151.00.

23.                     HPM facilities: $151.00.

24.                     High-piled storage: $151.00.

25.                     Hot work operations: $151.00.

26.                     Industrial ovens: $151.00.

27.                     Knox Box: $88.00.

28.                     Liquid- or gas-fueled vehicles or equipment in assembly buildings: $151.00.

29.                     Lithium batteries: $151.00.

30.                     LP-gas (LPG): $151.00.

31.                     Lumber yards and woodworking plants: $209.00.

32.                     Open flames and candles: $151.00.

35.                     Places of assembly (Occupant load = 50 - 1,000 persons): $150.00.

38.                     Places of assembly (Occupant load > 20,000 persons): $750.00.

39.                     Private fire hydrants: $117.00 (up to four hydrants).

40.                     Pyrotechnic fees: $290.00.

41.                     Pyroxylin plastics: $151.00.

42.                     Refrigeration equipment: $151.00.

43.                     Repair garages and motor fuel-dispensing facilities: $151.00.

44.                     Residential Board and Care operation: $151.00

45.                     Special event/fire watch-Owner provided: $88.00.

46.                     Spraying and dipping: $151.00.

47.                     Tents and temporary membrane structures: $151.00.

48.                     Tire storage (including scrap tires and tire by products): $151.00.

49.                     Wood products: $151.00.

Section 2.                     That Section 10.64.018 of the Metropolitan Code is hereby amended by adding the following subsection:

B.                     Re-inspections: Fees for a re-inspection shall be $65.00.

Section 3.                     That Section 10.64.018 of the Metropolitan Code is hereby amended by adding the following subsection:

 

C.                     The following fees will be tied to plan review and inspections tied to developmental permits:

1.                     Fire/Life Safety Plan Review & Inspections (Residential Projects)

i.                     Fire/Life Safety plan review fees shall be determined through the following steps:

1.                     Use the square footage and occupancy type of the project to determine the Fire/Life Safety factor via Table 10.64.018.1 Fire/Life Safety Table.

2.                     Use the construction type of the building or project to determine the Construction Type factor via Table 10.64.018.2 Construction Type Factor Table.

3.                     Multiply the Fire/Life Safety factor and Construction Type factor to find the Fire/Life Safety Plan Review factor.

4.                     The full cost of Fire/Life Safety Plan Review for the residential project is then determined by multiplying the Fire/Life Safety Plan Review factor by the Residential Fire/Life Safety Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table).

ii.                     Fire/Life Safety inspection fees shall be determined through the following steps:

1.                     Determine the project’s Fire/Life Safety Plan Review factor as stated above.

2.                     Double the Fire/Life Safety Plan Review factor to find the Fire/Life Safety Inspection factor.

3.                     The full cost of Fire/Life Safety Inspection for the residential project is then determined by multiplying the Fire/Life Safety Inspection factor by the Residential Fire/Life Safety Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table).

2.                     Fire/Life Safety Plan Review & Inspections (Commercial Projects)

i.                     Fire/Life Safety plan review fees shall be determined through the following steps:

1.                     Use the square footage and occupancy type of the project to determine the Fire/Life Safety factor via Table 10.64.018.1 Fire/Life Safety Table.

2.                     Use the construction type of the building or project to determine the Construction Type factor via Table 10.64.018.2 Construction Type Factor Table.

3.                     Multiply the Fire/Life Safety factor and Construction Type factor to find the Fire/Life Safety Plan Review factor.

4.                     The full cost of Fire/Life Safety Plan Review for the commercial project is then determined by multiplying the Fire/Life Safety Plan Review factor by the Commercial Fire/Life Safety Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table).

ii.                     Fire/Life Safety inspection fees shall be determined through the following steps:

1.                     Determine the project’s Fire/Life Safety Plan Review factor as stated above.

2.                     Double the Fire/Life Safety Plan Review factor to find the Fire/Life Safety Inspection factor.

3.                     The full cost of Fire/Life Safety Inspection for the commercial project is then determined by multiplying the Fire/Life Safety Inspection factor by the Commercial Fire/Life Safety Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table).

3.                     Fire Sprinkler System Plan Review & Inspections

i.                     Fire Sprinkler System plan review fees shall be determined through the following steps:

1.                     Use the square footage and occupancy type of the project to determine the Fire Sprinkler Plan Review factor via Table 10.64.018.3 Fire Sprinkler Systems Table.

2.                     Multiply the Fire Sprinkler Plan Review factor by the Fire Sprinkler Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Fire Sprinkler Plan Review for the project.

ii.                     Fire Sprinkler System inspection fees shall be determined through the following steps:

1.                     Determine the Fire Sprinkler Plan Review factor as stated above.

2.                     Double the Fire Sprinkler Plan Review factor to find the Fire Sprinkler Inspection factor.

3.                     Multiply the Fire Sprinkler Inspection factor by the Fire Sprinkler Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Fire Sprinkler inspections for the project.

4.                     Fire Alarm System Plan Review & Inspections

i.                     Fire Alarm plan review fees shall be determined through the following steps:

1.                     Use the total number of fire alarm devices being installed or modified to determine the Fire Alarm Plan Review factor in Table 10.64.018.4 Fire Alarm Systems Table.

2.                     Multiply the Fire Alarm Plan Review factor by the Fire Alarm Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Fire Alarm Plan Review for the project.

ii.                     Fire Alarm inspection fees shall be determined through the following steps:

1.                     Determine the Fire Alarm Plan Review factor as stated above.

2.                     Double the Fire Alarm Plan Review factor to find the Fire Alarm Inspection factor.

3.                     Multiply the Fire Alarm Inspection factor by the Fire Alarm Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Fire Alarm Inspection for the project.

5.                     Fire Extinguishment System (other than automatic sprinklers) Plan Review & Inspections

i.                     Fire Extinguishment plan review fees shall be determined through the following steps:

1.                     Use the total number of fire extinguishment system devices or nozzles being installed or modified to determine the Fire Extinguishment Plan Review factor in Table 10.64.018.5 Fire Extinguishment Systems Table.

2.                     Multiply the Fire Extinguishment Plan Review factor by the Fire Extinguishment Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Fire Extinguishment Plan Review for the project.

ii.                     Fire Extinguishment inspection fees shall be determined through the following steps:

1.                     Determine the Fire Extinguishment Plan Review factor as stated above.

2.                     Double the Fire Extinguishment Plan Review factor to find the Fire Extinguishment Inspection factor.

3.                     Multiply the Fire Extinguishment Inspection factor by the Fire Extinguishment Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Fire Extinguishment Inspection for the project.

6.                     Underground Fire Line Installation Plan Review & Inspections

i.                     Underground plan review fees shall be determined through the following steps:

1.                     Use the total length of pipe to be buried to determine the Underground Fire Line factor via Table 10.64.018.6 Underground Installation Table.

2.                     Multiply the total number of devices required to be hydrostatically tested and flow tested for the project by associated factor in Table 10.64.018.6 to determine the Hydro/Flow factor.

3.                     Add the Underground Fire Line factor and the Hydro/Flow factor together to find the Underground Plan Review factor.

4.                     Multiply the Underground Plan Review factor by the Underground Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Underground Plan Review for the project.

ii.                     Underground inspection fees shall be determined through the following steps:

1.                     Determine the Underground Plan Review factor as stated above.

2.                     Double the Underground Plan Review factor to find the Underground Inspection factor.

3.                     Multiply the Underground Inspection factor by the Underground Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of Underground Inspection for the project.

7.                     Emergency Power Supply Systems (EPSS) Plan Review & Inspections

i.                     EPSS plan review fees shall be determined through the following steps:

1.                     Use the appropriate fuel type and tank size (if applicable) to determine the EPSS Plan Review factor via Table 10.64.018.7 Emergency Power Supply Systems Table.

2.                     Multiply the EPSS Plan Review factor by the EPSS Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of EPSS Plan Review for the project.

ii.                     EPSS inspection fees shall be determined through the following steps:

1.                     Determine the EPSS Plan Review factor as stated above.

2.                     Double the EPSS Plan Review factor to find the EPSS Inspection factor.

3.                     Multiply the EPSS Inspection factor by the EPSS Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of EPSS Inspection for the project.

8.                     Firefighter Air Replenishment System (FARS) Plan Review & Inspections

i.                     FARS plan review fees shall be determined through the following steps:

1.                     Use the total square footage of the project or building to determine the FARS Plan Review factor via Table 10.64.018.8 Firefighter Air Replenishment System Table.

2.                     Multiply the FARS Plan Review factor by the FARS Plan Review fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of FARS Plan Review for the project.

ii.                     FARS inspection fees shall be determined through the following steps:

1.                     Determine the FARS Plan Review factor as stated above.

2.                     Double the FARS Plan Review factor to find the FARS Inspection factor.

3.                     Multiply the FARS Inspection factor by the FARS Inspection fee (found in Table 10.64.018.9 NFD - FMO Service Cost Table) to determine the full cost of FARS Inspection for the project.

Section 4.                     That Section 10.64.018 of the Metropolitan Code is hereby amended by deleting former Subsection B.

Section 5.                     This Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
