A resolution approving an agreement between CSX Transportation, Inc. (“CSX”), a Virginia corporation with its principal place of business in Jacksonville, Florida, and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”), to construct bridge repairs and painting at Hart Lane, Walton Lane, and Division Street. WHEREAS, as described in the construction agreement attached hereto and incorporated by reference herein, NDOT wishes to construct, or to cause to be constructed, bridge repairs and painting at Hart Lane, Walton Lane, and Division Street (“the Project”); and,
WHEREAS, BL2005-787 authorized approval of agreements between the Department of Public Works, now known as NDOT, and CSX by resolution of the Metropolitan Council; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this Agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the construction agreement between CSX Transportation, Inc. and the Nashville Department of Transportation and Multimodal Infrastructure, attached hereto and incorporated by reference herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That any amendments, renewals, or extensions of the term of this agreement may be approved by resolution of the Metropolitan Council.
Section 3. That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an agreement between CSX Transportation, Inc. (“CSX”) and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) to construct bridge repairs and painting at Hart Lane, Walton Lane, and Division Street.
The agreement provides that CSX would perform preliminary engineering services, flagging services, other necessary protective services and devices, and construction engineering and inspection. NDOT shall allow for the removal of debris and remove graffiti from a Division Street bridge, perform repairs to bridge deck and concrete beams at Hart Lane, and perform repairs and repaint concrete beams at Walton Lane.
NDOT will reimburse CSX for the costs and expenses associated with the project, estimated to be $191,885.
Ordinance No. BL2005-787 authorized approval of agreements between the Department of Public Works (now NDOT) and CSX through a Metropolitan Council resolution.
Fiscal Note: Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) would reimburse CSX Transportation, Inc. (“CSX”) the estimated cost in the amount of $191,885 to construct the bridge repairs and painting at Hart Lane, Walton Lane, and Division Street.
