A resolution to amend Ordinance No. BL2024-204 to authorize The Metropolitan Government of Nashville and Davidson County to modify the acceptance of water and sanitary sewer mains, sanitary sewer manholes and easements, for two properties located at 4030 Whites Creek Pike and Whites Creek Pike (unnumbered), also now known as Cherry Grove - Revision 01 (MWS Project Nos. 23-WL-81 and 23-SL-211 and Proposal No. 2023M-207ES-002).

WHEREAS, Ordinance No. BL2024-204, approved, March 8, 2024, authorized the acceptance of approximately 145 linear feet of new eight-inch water main (DIP) approximately 548 linear feet of new eight-inch sanitary sewer main (DIP), approximately 322 linear feet of new eight-inch sanitary sewer main (PVC) and seven sanitary sewer manholes, for two properties located at 4030 Whites Creek Pike and Whites Creek Pike (unnumbered), also now known as Cherry Grove; and,
WHEREAS, the acceptance of approximately three fewer linear feet of new eight-inch water main (DIP), approximately 540 additional linear feet of new eight-inch sanitary sewer main (PVC), one additional sanitary sewer manhole and easements, are now needed to construct Project Nos. 23-WL-81 and 23-SL-211; and,
WHEREAS, the previously approved approximately 548 linear feet of eight-inch sanitary sewer main (DIP) is no longer needed; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-207ES-002 on September 17, 2026, for revisions to the original mandatory referral; and,
WHEREAS, Ordinance No. BL2024-204 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2024-204 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to accept approximately 142 linear feet of new eight-inch water main (DIP), approximately 862 linear feet of new eight-inch sanitary sewer main (PVC), eight sanitary sewer manholes and easements, for two properties located at 4030 Whites Creek Pike and Whites Creek Pike (unnumbered), also known as Cherry Grove - Revision 01, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance authorized by this resolution.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends Ordinance No. BL2024-204, which was approved by the Metropolitan Council on March 8, 2024. The ordinance accepted approximately 145 linear feet of new eight-inch water main (DIP), approximately 548 linear feet of new eight-inch sanitary sewer main (DIP), approximately 322 linear feet of new eight-inch sanitary sewer main (PVC) and seven sanitary sewer manholes, for two properties located at 4030 Whites Creek Pike and Whites Creek Pike (unnumbered), also known as Cherry Grove. BL2024-204 may be amended by resolution of the Metropolitan Council.
The proposed resolution would amend BL2024-204 to accept three fewer linear feet of new eight-inch water main (DIP), approximately 540 additional linear feet of new eight-inch sanitary sewer main (PVC), 548 fewer linear feet of new eight-inch sanitary sewer main (DIP), and one additional sanitary sewer manhole and easements.
This amendment has been approved by the Planning Commission.
