WHEREAS, the abandonment of approximately 11 linear feet of existing three-inch water main (DIP), approximately 312 linear feet of existing 12-inch sanitary sewer main (VCP), and one sanitary sewer manhole, and the acceptance of approximately 12 linear feet of new three-inch water main (DIP), approximately 126 linear feet of new 12-inch sanitary sewer main (PVC), approximately 186 linear feet of new 12-inch sanitary sewer main (DIP) and two sanitary sewer manholes, for property located at 118 12th Avenue South, also known as Hyatt Caption Hotel, are needed to construct project numbers 23-WL-56 and 22-SL-279; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-121ES-001 on July 26, 2023, for the abandonment and acceptance of said water and sanitary sewer mains and sanitary sewer manholes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 11 linear feet of existing three-inch water main (DIP), approximately 312 linear feet of existing 12-inch sanitary sewer main (VCP), and one sanitary sewer manhole, and to accept approximately 12 linear feet of new three-inch water main (DIP), approximately 126 linear feet of new 12-inch sanitary sewer main (PVC), approximately 186 linear feet of new 12-inch sanitary sewer main (DIP) and two sanitary sewer manholes, for property located at 118 12th Avenue South, also known as Hyatt Caption Hotel, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
