WHEREAS, on July 15, 2023, a water main break occurred in the front yard of Whitney Drury’s home located at 1206 Sixth Avenue North, Unit 3, causing extensive water and property damage to the home; and,  

WHEREAS, after investigation, the Department of Law believes the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the property damage claim of Whitney Drury be compromised and settled for a total of $18,028.50, and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1:                       The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of Whitney Drury for the sum of $18,028.50, with said amount to be paid from the Self-Insured Liability Fund.

Section 2:                       This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

On July 15, 2023, a water main break occurred in front of Whitney Drury’s residence at 1206 Sixth Avenue North, Unit 3. The water main was directly in front of the home and the residence’s front wall. Metro Water Services arrived, turned off the water, completed the repair, and indicated that the break was due to natural causes.

 

The walls, baseboards, drywall, and door frames of the home were damaged. Repairs included the removal of the water, damaged drywall, baseboards, and door frames. Additional repairs included removal of rock and pressure washing of exposed foundation walls before exterior water proofing was applied. New base board and door casings were installed, and walls and trim were painted.

 

The Department of Law recommends settlement of Whitney Drury’s property damage claim for $18,028.50.

 

Fiscal note: This $18,028.50 settlement, along with the settlements per Resolution Nos. RS2023-13, RS2023-14 and RS2023-40 would be the 6th, 7th, 8th and 9th payments from the Self-Insured Liability Fund in FY24 for a cumulative total of $417,307.
