An ordinance approving Amendment 2 to contract number 459172 between the Metropolitan Government of Nashville and Davidson County, through the Department of Water and Sewerage Services, and CDM Smith.

WHEREAS, the Metropolitan Government of Nashville and Davidson County, through the Department of Water and Sewerage Services, entered into a contract with CDM Smith for design solutions and services, drawings, construction documents, cost estimating, scheduling services, and construction phase services for reservoir improvements at various Metro sites; and
WHEREAS, Ordinance No. BL2024-355 approved Amendment 1 to contract number 459172, which extended the term of the contract until project completion; and
WHEREAS, Amendment 2 to the contract increases the contract value by $400,000, from $1,200,000 to $1,600,000, replaces Exhibit A - Pricing, removes the requirement to identify the project name, RFQ or Contract number on the ACORD document, and adds new terms related to Outstanding Purchase Orders, Survival, Tennessee Procurement Protection Act, and Conflicting Vendor Terms; and
WHEREAS, it is in the best interest of the Metropolitan Government that this amendment be approved.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Amendment No. 2 to the Contract between the Metropolitan Government of Nashville and Davidson County and CDM Smith (contract number 459172), a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. Amendments to this legislation shall be approved by resolution.
Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
