NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 16.28.080.B of the Metropolitan Code of Laws is hereby amended by deleting the section in its entirety and replacing it with the following:
The director of codes administration and the Fire Marshal may accept plans and a sworn affidavit from a registered architect or engineer, affixed with his or her seal, stating that the plans submitted conform with all provisions of this chapter and all other pertinent laws and ordinances. The director of codes administration and Fire Marshall may rely upon such affidavit and in their discretion approve the plans submitted therewith without further review. In such event, the architect or engineer having provided the affidavit shall assume full responsibility for the compliance of such plans with all provisions of this chapter and other pertinent laws or ordinances. Architects and engineers hereinabove referred to shall be registered under the laws of this state regulating the practice of architecture and engineering. Nothing in this Chapter shall be construed to waive inspection requirements or the authority of the director of codes administration or Fire Marshall to reject work not in compliance with the provisions of this chapter or other applicable laws or ordinances.
Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
